On Monday, OpenAI sent a letter to the Attorneys General of California and Delaware, urging them to investigate the "misconduct and anti-competitive behaviors" of Elon Musk and related parties. A highly anticipated trial between the two sides is about to begin.
In the letter, OpenAI's Head of Strategy, Jason Kwon, alleged that Musk has been trying to weaken OpenAI through various "attacks," including "coordinated actions" with Meta CEO Mark Zuckerberg.
Elon Musk and OpenAI CEO Sam Altman, along with several researchers and executives, co-founded OpenAI in 2015 as a nonprofit. In 2018, Musk left after unsuccessfully trying to convince company executives to merge OpenAI with Tesla. He later founded xAI and, in 2024, sued OpenAI, alleging he was "carefully manipulated" and "deceived" during the company's exploration of becoming a for-profit entity.
Jury selection for this trial is expected to begin on April 27 at the U.S. District Court for the Northern District of California.
In the letter, Kwon stated that Musk's actions could hinder OpenAI's efforts to advance artificial general intelligence (AGI). Kwon wrote:
"The purpose of these attacks is to take away future control of AGI from those who are legally required to ensure AGI benefits all of humanity, and transfer it to competitors who lack mission-driven principles and refuse to take on safety responsibilities."
OpenAI has previously expressed similar concerns. In January of this year, the company sent a letter to investors and banking partners, warning that as Musk's lawsuit against the AI lab heads to trial, he is expected to make "deliberately exaggerated and attention-grabbing statements."
In that letter, OpenAI stated that Musk would likely make statements "not aligned with reality," and said such remarks were "part of the harassment tactics he has routinely used in the past."
